“We don't know what's going on,” said the victim’s mother, Angela Hernandez. “I don't believe that he choked on an apple. I don't believe the story that they're giving us.”
A grieving family is left with many questions after learning about the death of their son, Vincent Chacon.
“My son was perfectly fine and was being ready to be released and all of a sudden he chokes on an apple upon a new cell, 'celly,' that doesn't make sense,” Hernandez said.
Hernandez wants to know what happened at the Downtown Denver Detention Center on Monday morning around 2 a.m.
A probable cause statement for the arrest of a man, Rick Roybal-Smith, says he was sharing a cell with Hernandez’s son. It states a deputy sheriff was alerted by Roybal-Smith that Chacon was choking on an apple and needed help.
A few paragraphs down, it states the following:
“Officers informed Mr. Roybal-Smith that they would be able to provide him with water, after they apply evidence collection gloves on his hands, at which time Mr. Roybal-Smith became upset and abruptly stated 'I did it, you might as well kill me now.'"
“If they called this an accident and that he choked, why are they holding this guy on no bond and a homicide?” Hernandez said.
FOX31 called and emailed the coroner’s office. We were told the team at the Medical Examiner’s Office is still working on this case.
Roybal-Smith is currently being held for investigation of first-degree murder. When we asked the district attorney’s office if there were any updates or official charges on Wednesday, FOX31 was told there are no updates yet.
FOX31 emailed and texted the sheriff’s office, which oversees the jail, because the victim’s family does not understand why Chacon was still in a cell in the first place when the death occurred.
“We received a text from Denver County Saturday saying they had released him,” Hernandez said. “Monday morning, they said they didn’t have him there. Then Tuesday morning, the coroner called to tell me he had passed.”
Additionally, the family says a detective told them Roybal-Smith could be a person of interest in another deadly situation in the metro that happened Sunday before he was taken into custody.
FOX31 reached out to Aurora police to ask if there is a connection to two deadly stabbings on Sunday morning.
“There are no new updates to our stabbing investigation at this moment,” a spokesperson replied. “We have not identified, arrested, or charged anyone, and we cannot release the name of our person of interest.”
FOX31 also asked the Denver Sheriff’s Office what the protocol is on placing people in cells together, and if those accused of dangerous crimes impact who is placed with one another. We received a response from the Denver Department of Public Safety stating:
“At this time, we are unable to provide any additional information beyond what the Denver Police Department has released due to the open homicide investigation.”
“I just want justice for my son,” Hernandez said.
