Nasir El-Rufai, the former governor of Kaduna State, has spent almost eight months in the custody of Nigeria’s anti-graft agency. On Wednesday 14 October he was back in a Kaduna courtroom, where prosecutors opposed bail for his former aide.

For foreign readers, his case is a test of how Africa’s most populous country treats a leading opposition figure before the 2027 election. El-Rufai has pleaded not guilty to every charge and says the prosecutions are politically motivated.

Who Is Nasir El-Rufai

El-Rufai governed Kaduna, a large state in northern Nigeria, from 2015 to 2023 as a member of the ruling All Progressives Congress (APC). The APC is the party of President Bola Tinubu, who leads the federal government.

He later broke with the ruling party and joined the opposition African Democratic Congress (ADC). In September 2026, former vice president Atiku Abubakar, the ADC presidential candidate, named him deputy chairman of his campaign council.

That makes El-Rufai one of the most senior opposition figures facing trial ahead of the vote on 16 January 2027. At recent hearings he arrived with Isa Ashiru Kudan, the ADC candidate for governor of Kaduna State.

The Probes Against Nasir El-Rufai

The cases are brought by the Independent Corrupt Practices and Other Related Offences Commission (ICPC), the federal agency that prosecutes graft by public officials. Premium Times reports they stem largely from a 2024 Kaduna State House of Assembly probe of his administration.

At the Federal High Court in Kaduna, the ICPC has arraigned him with Jimi Lawal, his former senior special adviser, and five companies. The amended charge has 11 counts under the Money Laundering (Prevention and Prohibition) Act of 2022.

The ICPC alleges that in December 2015 he approved a CCTV contract worth N8.68 billion (about US$6.5 million) for Kaduna city. It says the contract went to Singularity Network Security Limited, a firm it alleges lacked the required experience.

The commission also alleges that more than N2 billion (about US$1.5 million) moved through several companies between 2017 and 2022. These are allegations in a charge sheet, and no court has ruled on them.

A separate ICPC case at the Kaduna State High Court covers alleged abuse of office and misuse of funds, on nine counts according to Daily Trust. Premium Times says the ICPC has also charged him with tapping the phone of National Security Adviser Nuhu Ribadu.

Custody, Bail and Disputed Evidence

El-Rufai has been held by the ICPC since 18 February under a court order, The ICIR reports. On Friday 9 October, a three-judge Court of Appeal panel in Kaduna unanimously upheld the refusal of his bail.

On Tuesday 13 October, a forensic expert from the State Security Service testified in the state case. He alleged that El-Rufai planned to spend US$600,000 to stall an investigation by another agency, the Economic and Financial Crimes Commission.

Premium Times stressed that this is prosecution evidence the court has not established. Defence counsel Paul Erokoro, a senior advocate, objected that the defence had no prior notice of the witness, but the judge allowed the testimony.

El-Rufai is also suing the ICPC at the Federal High Court in Abuja, seeking N1 billion (about US$751,000) in damages. He says the agency unlawfully blocked visits by his wife and son in July, while the ICPC says it restricted access lawfully on security grounds.

The state trial resumes on 30 November, and the federal trial is due to begin on 8 December. Our explainer Nigeria Opposes Bail for El-Rufai Aide Lawal covers the Friday 16 October bail hearing for Lawal.

What It Means for US Readers

The state-case witness described plans to keep investigators away from a company listed on the New York Stock Exchange, which Premium Times did not name. Daily Trust reported that the recordings mentioned the tower operator IHS, but no US-listed firm has been charged.

For investors, the trials are a gauge of judicial independence in Nigeria before a closely fought election. Dollar figures here use the Central Bank of Nigeria’s official rate of N1,332.09 per US$1 on 14 October.

The courts have so far followed normal appeal routes, and El-Rufai has been represented by senior advocates at his hearings. Travellers should note that the US State Department rates Nigeria at Level 3, “reconsider travel.”

What Is Not Known

It is not known whether El-Rufai will seek bail again or take his case to the Supreme Court. The audio evidence has not yet been tested in cross-examination, which resumes on 30 November.

It is also unclear how his detention will affect the ADC campaign he helps lead. The ICPC has not said when it expects either trial to conclude.
